Terms & conditions of sale

These terms govern every order placed on the Nosa site. We invite you to read them before completing your purchase.

Article 1 — Purpose and scope

These General Terms and Conditions of Sale (the “Terms”) govern all sales of products concluded on the Nosa website (the “Site”) between Nosa (the “Seller”) and any non-trader individual making a purchase (the “Customer”).

Any order placed on the Site implies prior, unreserved and full acceptance of these Terms. The Customer acknowledges having read them before validating their order.

The Seller reserves the right to amend these Terms at any time. The applicable Terms are those in force on the date of the order.

Article 3 — Products

The products offered for sale are artisanal candles and decorative objects crafted from re-used Burgundy wine bottles (“upcycling”). As each piece is handmade, slight variations (glass tint, label, dimensions) may occur and do not constitute a defect.

The essential characteristics of each product are described on its product page. Photographs are provided for illustration only and are not contractual.

Offers are valid while stocks last. If a product becomes unavailable after an order, the Customer is informed and refunded any sums paid.

As our products involve an open flame, they must be used in accordance with the safety instructions provided (never leave a lit candle unattended, keep out of reach of children and pets).

Article 4 — Prices

Prices are shown in euros (€), all taxes included, excluding delivery costs. Any delivery costs are specified before final validation of the order.

The Seller may change prices at any time; products are invoiced on the basis of the rates in force at the time the order is recorded.

Article 5 — Orders

The Customer selects the products, checks the cart, provides their details and proceeds to payment. Validation of the order constitutes conclusion of the sales contract.

A confirmation email summarising the order is sent to the Customer. The Seller may refuse or cancel any order for a legitimate reason (payment dispute, abnormal order, etc.).

Article 6 — Payment

Payment is made online by credit/debit card via our secure payment provider Stripe. Payment data is transmitted in encrypted form and is never stored by the Seller.

The order is final only once payment has been effectively received. In the event of payment failure or refusal, the order is automatically cancelled.

Article 7 — Delivery

Products are delivered to the address provided by the Customer, within the timeframes indicated at purchase. Timeframes are indicative; a delay cannot give rise to damages.

Transport risks transfer to the Customer upon physical possession of the products. The Customer should check the parcel on delivery and report any issue to the carrier and the Seller.

As our products are fragile (glass), they are carefully packaged and protected.

Article 8 — Right of withdrawal

In accordance with articles L221-18 et seq. of the French Consumer Code, the Customer has fourteen (14) days from receipt of the products to exercise their right of withdrawal, without justification or penalty.

To exercise this right, the Customer notifies their decision by an unambiguous statement (email to contact@maisonnosa.com or letter), or using the model form below.

Products must be returned in their original, complete condition within fourteen (14) days of notification. Return costs are borne by the Customer. The Seller refunds the sums paid (excluding return costs) within fourteen (14) days of recovering the products or proof of their shipment.

Exceptions: the right of withdrawal does not apply to custom-made or clearly personalised goods (article L221-28 of the Consumer Code).

Article 9 — Legal warranties

Irrespective of any commercial warranty, the Seller remains bound by the legal warranty of conformity (articles L217-3 et seq. of the Consumer Code) and the warranty against hidden defects (articles 1641 et seq. of the Civil Code).

Under the legal warranty of conformity, the Customer has two (2) years from delivery of the goods; they may choose between repair or replacement, subject to the cost conditions provided by law.

To invoke these warranties, the Customer contacts the Seller at contact@maisonnosa.com.

Article 10 — Liability

The Seller cannot be held liable for misuse of the products, in particular failure to follow the safety instructions relating to candle use (open flame).

The Seller's liability cannot be engaged for any damage resulting from force majeure or the unforeseeable and insurmountable act of a third party.

Article 11 — Personal data

Personal data collected in connection with orders is processed in accordance with our Privacy Policy and the General Data Protection Regulation (GDPR).

The Customer has the right to access, rectify, erase and object to their data, which can be exercised at contact@maisonnosa.com.

Article 12 — Intellectual property

All elements of the Site (texts, visuals, logo, branding, the “Nosa” trademark) are protected by intellectual property law and remain the exclusive property of the Seller. Any reproduction without authorisation is prohibited.

Article 13 — Mediation and dispute resolution

In the event of a dispute, the Customer first contacts the Seller to seek an amicable solution.

In accordance with article L612-1 of the Consumer Code, the Customer may use a consumer mediator free of charge: [mediator name and details to be completed].

The Customer may also use the European Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.

Article 14 — Governing law and language

These Terms are governed by French law. In case of translation, only the French version is authoritative.

Failing an amicable resolution, any dispute falls under the jurisdiction of the competent French courts.
